Actually my ex would say I am a bitch because the total $$$ amount he is paying me when it is all said and done is pretty high, but IMO he can afford it and I did move across the country and left my friends and family and career so that he could start a career and now he is set to make 6 figures in the next couple of years and I have NOTHING career-wise.

He is actually pretty awesome in a lot of ways because he just got a huge raise (16%) which he could have kept a secret but instead he called and told me about it so we may go back to our financial adviser and have her refigure child support. I really only have a right to request that if he gets a 20% bump in income, but he doesn't want to be unfair to mini-undie.

Anyway...Yes, I had to sign over my right to the tax break, and that is a decision I get to make each year. It would totally depend on the good will of your ex. It seemed only fair and logical. We did not even go to a court, but did something called "cooperative law" where our attorneys worked out everything and then a judge signed off on it. I think it was very good for our daughter who did not have to see us fighting or go into a courtroom, but it was very expensive, we paid over $12K in attorney fees alone.

The loser in all this mess is Suri. She's made a public figure without her consent, so now the tabloids will hound her until she grows up... and maybe even after that. Every awkward gaff, every mis-step, every zit or normal issue will be put on the internet & discussed ad nauseum. It's hard enough growing up in a normal environment; now she has to do it in the harsh scrutiny of the public eye...

I guess I shouldn't compare my situation because I bent over, pulled my pants down and basically let her and her attorney fuck the living shit out of me in front of the courtroom without so much as spitting in their hand to lube me up first. This is how I understand it:

I get spousal support and child support, and if you look at in on paper, the spousal support number looks HUGE, and the child support number looks really SMALL. This is because my ex cannot deduct child support, but he can deduct any spousal support he pays. Does that make sense?

When we got divorced I was a SAHM so I had no job, so he could pay me a lot and I would still be in the lowest tax bracket, so he was able to drop into a lower tax bracket by paying me all of the "child support" as "spousal support". For some reason we still had to classify a very minimum of it as child support though.

For some reason, my ex pays taxes on whatever child support he pays, but I don't pay on any child support I receive. (IDK why.) I DO pay taxes on any spousal support I receive, but having no job at the time, that still put me in the lowest tax bracket.

Because I am not an asshole, I also signed over the child tax credit to my ex for the period where his is paying spousal support, which is only a few more years. I still get to claim head of household.

So this means Katie is getting $33K is tax-free income!

Also, you and your ex-wife can decide who is going to get the deduction for your child, so even though you aren't able to deduct your child support payment, you're still getting the tax credit for your child, just like you would if you were still married and all living like a perfect happy family. That's what my ex and I did since he was essentially still pay for all her expenses through child support and (for a few years) spousal support, even though mini-undie is living with me, it makes sense that he would get the tax break.

In CA TOmmy girl will have to put on his tax forms how much he pays, and Katiebot will have to claim how much she recieves. If I'm correct, the payee gets to claim the tax credit on the payments.
